Poonam Successfully Defends Local Authority On Out Of Time Appeal

Poonam represented the local authority arguing that there was “no good reason” why the appeal was made late, this was despite the fact that the housing authority had not made a decision on a section 202 review when it had been asked to do so.

The case is of interest because the county court was asked to consider the interplay between “good reason” in section 204 for an extension of time and the mandatory duty arising under section 202 of the 1996 Act.
