Aleks represented the defendant in relation to an allegation of a kidnapping of a 67 year old woman on a path in the early hours of the morning by a stranger. Despite admitting presence the defendant was acquitted after trial of both the kidnapping and a count of ABH linked to the same incident where the issue was the causation of the injuries.
The subtext of the case was that the kidnapping was a precursor to a sexual assault. The defendant had a previous conviction for rape involving him climbing through a stranger’s window and raping the 47 year old female resident in her bed. That previous conviction did not appear as part of the prosecution case.
