B’s appeal against the imposition of an abatement notice was dismissed on the second day of the hearing. Wiltshire Council had served an abatement notice on B as he had caused a statutory nuisance by persistently burning waste on a commercial scale, resulting in residents suffering from sore throats and stinging eyes as a result of the smoke.
