Adrian Peck has successfully represented a local authority in the Employment Appeal Tribunal

The claimant had appealed an Employment Tribunal decision to strike out his unfair dismissal claim and to refuse an application for reconsideration. The central issue in the claimant’s appeal was whether the Employment Judge below had erred in not considering a psychologist’s letter which the claimant had submitted in support of his application.
Dismissing the claimant’s appeal in a judgment handed down on 10 September 2026, HHJ Joffe upheld the Employment Tribunal’s original decision on the basis that, although the Employment Judge had failed to take account of matters which were relevant to the exercise of his discretions, his errors did not and could not affect the result.
