The team includes a growing number of members who devote all or a majority of their practice to this specialist area.
In housing cases, members offer advice and advocacy on the full range of issues that can arise. They are instructed predominantly by social landlords but also act for individual clients on a private and publicly funded basis. They have particular expertise in cases involving anti-social behaviour, but also advise clients on the full range of residential property issues including disrepair and leasehold enfranchisement.
Members also specialise in public law aspects of housing, including statutory reviews of and appeals against homelessness decisions, judicial review and appeals against Housing Act notices. They give strategic advice on housing issues and have assisted in the formulation of policy and the drafting of agreements.
More senior members have extensive experience in cases under Part II of the Landlord & Tenant Act, 1954, and all issues involving commercial property including:
- Dilapidations
- Rent review
- The interpretation and enforcement of leasehold covenants
- Agricultural holdings and tenancies and agricultural production controls
- Negligence of property professionals
- Human rights implications of property law
