2011 – A significant case involving safe systems of asbestos removal from retail stores, whilst continuing to trade. The case examined the respective technical merits of large and small scale asbestos removal and the potential for spread of asbestos fibres whilst using mini-enclosures and standard control measures.
The case also considered the extent to which a retailer can rely on the expertise of a Principal Contractor and specialist Licensed Asbestos Removal Contractor in discharging its duties under the Health and Safety at Work etc. Act 1974
