General Crime:
Crime and Regulatory offences, including Health and Safety at Work, Product Safety, Food Safety, Trading Standards, Trade Marks and Environmental Law. By inclination a defence advocate, with clients ranging from national companies through to individuals facing charges as diverse as drug trafficking and serious violence. Has particular expertise in systems of 'due diligence' and 'best practicable means' used in corporate retailing. Prosecutes for Local Authorities, HSE and the Environment Agency.
Health and Safety:
This is a discrete area of practice where Malcolm has specialist knowledge and expertise. Over the years he has undertaken a number of high profile health and safety cases both prosecuting for local authorities and defending on behalf of national retail companies.
Amongst the cases that he has undertaken he has dealt with issues such as the definition of meat products and exemptions under existing EU directives, sentencing guidelines and inconsistent verdicts following a fatal accident at work, prosecutions concerning the cleanliness of food products, various prosecutions following in store accidents at retail outlets and similar cases following breaches of other areas of Health & Safety legislation.
In addition he has also conducted cases concerning the storage of fireworks and on the failure to dispose of waste material via existing prescribed means.
