Practises mainly in Chancery and related areas, both in the public and private sectors. Specialises in Bankruptcy, Boundaries, Town & Village Greens, Company (contentious and non-contentious), Compulsory Purchase, Contractual Disputes concerning Transfers of land, Disputed Co-Ownership, Easements, Highways, Inheritance, Landlord and Tenant (residential. business and agricultural), Mortgages, Restrictive Covenants (including applications to the Lands Tribunal for modification or discharge), Trusts, Wills and Probate (including drafting) and related Professional Negligence in all areas.
He is a particular specialist at town & village greens (TVGs). He acts for applicants for registration, objector landowners and registration authorities. He also sits as an Inspector at non-statutory inquiries. Mr Webster also lectures on TVGs and now that land can too easily qualify for registration (often on the basis of little more public activity than walking the dog), he is spending more time dealing with TVGs and related areas.
In January he will be giving Seminars in Southampton and in the west country on this subject which will include relevant and up to date case law and statutory provisions. These will include :
- review of registration framework under the Commons Act 2006
- how TVG status can prevent development
-the Redcar case - 'as of right'
-the recreational trust issue - permissive use with special reference to local authority open space and the notion of an implied statutory licence after Beresford case
-the circumstances in which, after Betterment, the register of TVG can be rectified to remove land mistakenly registered as a TVG by application made under S.14 of the Commons Registration Act 1965 (still on foot despite the 2006 Act)
-de-registration and exchange under sections 165/18 of the 2006 Act
