Residential L&T
He is regularly instructed in this field by or on behalf of local authorities and other social landlords, as well as large corporate and individual clients.
He has a wide experience in all codes of security of tenure. He has particular expertise in possession claims and other applications (including ASBIs and ASBOs) brought on the basis of anti-social behaviour, having appeared in some of the leading cases in the field. He also advises on disrepair matters, service charge disputes, environmental health issues and upon leasehold enfranchisement claims.
He has appeared before Courts at all levels and before the Leasehold Valuation and Lands Tribunals.
Housing
He has extensive experience in the field of public sector housing, with special expertise in issues arising under Parts VI (allocations) and VII (homelessness) of the Housing Act 1996. He has represented both local authorities and individuals in judicial review claims and statutory appeals.
Aside from litigation, he is regularly asked to advise on strategic and policy issues relating to social housing. This work has a broad scope and has included matters relating to the relationship between social housing providers and clients, regulators, funders, service providers and other public authorities. He has drafted policies, procedures and tenancy and other agreements.
He also conducts seminars and other training activities for the operational and legal staff of social landlords and for Solicitors in private practice.
Commercial L&T
On the commercial side, he has expertise in respect of matters arising under Part II of the Landlord and Tenant Act 1954, dilapidations claims, rent reviews and the interpretation and enforcement of leasehold covenants.
He is regularly instructed in this field by or on behalf of large and small companies, public authorities and private clients. He is instructed by Solicitors from across the United Kingdom on behalf of well known national trading entities. He also accepts direct instructions from Surveyors in this field.
Land
A significant part of his practice is devoted to advocacy and advisory work in the field of land based chancery work. This includes trusts of land, restrictive covenants, easements, boundary disputes and mortgages. In addition, he is regularly instructed to deal with contractual disputes over the sale of land. He has appeared in Courts at all levels and has also appeared before HM Land Registry Adjudicators.
As well as undertaking private client work, he also advises developers on aspects of land acquisition and other non-contentious work.
